Users are not required to pay any fees to BestLifeSenior for using our service. Instead, our revenue comes from partnerships with senior living providers.BestLifeSenior does not guarantee placement at any facility or the quality of service provided by any third-party provider.

All information provided on BestLifeSenior is for informational purposes only. We do not offer medical, legal, or financial advice. Users should consult with a licensed healthcare professional before making any senior care decisions.

5. THIRD-PARTY SERVICES & LEAD MATCHING

By using BestLifeSenior, you acknowledge and agree that:

- You may be contacted bythird-party senior care providersthat we match you with.
- We donotendorse, control, or guarantee the services of any provider.
- Providers may have their own terms, privacy policies, and pricing structures, and users should review them separately.

BestLifeSenior makes no guarantees regarding availability, pricing, or outcomes of services provided by third parties.

6. TCPA & COMMUNICATION CONSENT

By submitting your contact information, you expressly consent to receive:

Calls, SMS messages, and emails from BestLifeSenior and its partnered providers.

Marketing communications, even if your phone number is on aDo Not Call (DNC) registry.

Communication via anautomated dialing systemfor marketing purposes.

7. USER CONDUCT

You agree not to:

Continued use of our services after an update constitutes acceptance of the new terms.

11. DISPUTE RESOLUTION & MANDATORY BINDING ARBITRATION

1. Exclusive Dispute Resolution Through Arbitration

By using BestLifeSenior’s services, you expressly agree that any dispute, claim, or controversy
arising out of or related to these Terms of Service, including but not limited to interpretation, breach, termination, enforcement, or validity, shall be resolved exclusively through binding arbitration, not in court.

2. No Lawsuits, No Jury Trials, No Class Actions

No Court Proceedings:
You waive any right to bring a lawsuit
in any state or federal court in the United States or any other jurisdiction.

No Jury Trials:
You waive any right to a jury trial.

No Class Actions:
You agree that you may only bring claims on an individual basis.
You waive any right to participate in any class action, collective, or representative proceeding.

3. Arbitration Process & Governing Rules

All disputes shall be submitted to final and binding arbitration under the administration of the
American Arbitration Association (AAA), conducted in accordance with the AAA Commercial Arbitration Rules.

The arbitration shall be:

✔ Conducted in Delaware, United States.

✔ Presided over by a single, neutral arbitrator.

✔ Final and legally binding, with no right to appeal.

4. Governing Law: Delaware

These Terms of Service, including this arbitration agreement, shall be governed by and construed under the laws of the State of Delaware, without regard to conflict of law principles.

5. Waiver of Certain Damages & Attorney’s Fees

To the maximum extent permitted by law, you agree that:

✔ You waive any right to seek punitive, consequential, or indirect damages.

✔ Each party is responsible for its own attorney’s fees.

6. Severability

If any part of this arbitration clause is found to be invalid or unenforceable, the remainder shall still be fully enforceableto the maximum extent permitted by law.

7. Opt-Out Option (Optional)

You may opt-out of this arbitration agreement only by providing written notice to
[email protected] within 30 days of your first use of BestLifeSenior’s services. If you opt-out, your only recourse for disputes shall be small claims court in Delaware.
